UK Visas & Immigration (UKVI) will introduce a new restriction, known as the “Visa Brake”, from 26 March 2026, affecting specific visa routes and nationalities where a high proportion of issued visas are later used to claim asylum.
Key Points:
- The measure applies to Skilled Worker visa applications submitted outside the UK for nationals of Afghanistan, Cameroon, Myanmar, and Sudan.
- Any new applications from these nationals submitted on or after 26 March 2026 will be automatically refused, even if a Certificate of Sponsorship (CoS) has been issued.
- Existing employees with valid visas are not affected and may continue working under their current conditions.
- Dependents of affected applicants will also be impacted if the main applicant’s application is refused.
Sponsor and Employer Guidance:
- Review CoS already issued to affected nationals and consider submission before 26 March 2026.
- Avoid issuing new CoS for affected nationals if applications cannot be submitted before the deadline.
- Strengthen due diligence for Skilled Worker applications, including verifying identity, nationality, employment history, and prior immigration history.
Additional Notes:
- Visa and CoS fees will not be refunded if the application is refused under the Visa Brake.
- The measure will be kept under regular review, but no end date has been confirmed.
