CANADA (ONTARIO) | OINP Regulatory Amendments Now in Force — Program Redesign Ahead

Effective May 30, 2026, amendments to Ontario Regulation 421/17 under the Ontario Immigration Act, 2015 have come into force. The changes, first announced in a program update on March 16, 2026, lay the legal groundwork for a redesign of the Ontario Immigrant Nominee Program (OINP).

What Changed:

The amendments restructure the legal framework underpinning the OINP. Most notably, the regulation no longer enumerates the program’s fixed nomination streams (including the Employer Job Offer, International Student, Master’s and PhD Graduate, Human Capital Priorities, French-Speaking Skilled Worker, Skilled Trades, In-Demand Skills, and Entrepreneur categories). Instead, the province now has broader authority to introduce, modify, or discontinue immigration pathways and to issue both general and targeted invitations to apply.

The OINP has not been canceled, and these amendments do not announce new streams or eligibility criteria. Rather, they give Ontario the flexibility it needs to launch the redesigned program, the details of which have not yet been published.

What This Means for Applicants and Employers:

  • Applications already submitted are protected. All applications received under the existing OINP framework will be assessed in accordance with the eligibility requirements in place at the time of application.
  • A redesigned program is expected. Ontario has signaled a shift toward a more targeted, labor-market-driven selection model, but new stream criteria have not yet been announced. Candidates with profiles in the Expression of Interest (EOI) system and employers planning Ontario-based sponsorship should anticipate changes to eligibility criteria and selection processes.
  • Monitor official sources. Further announcements will be published on the OINP program updates page. The amended regulation text is available on Ontario’s e-Laws.

Our Take:

These amendments mark the most significant structural change to the OINP since the program’s inception. We recommend that affected candidates and employers review their immigration strategies now and prepare for new program criteria once announced.
