On May 15, 2026, amendments to the General Guidelines for the Issuance of Visas were published in the Mexican Official Gazette (DOF) by the Ministries of the Interior and of Foreign Affairs. The updates entered into force on May 16, 2026.
These amendments are particularly relevant to Temporary Resident Visa applications based on an offer of employment, which is the primary immigration route for foreign nationals performing remunerated activities in Mexico.
What Has Changed:
The amendments introduce more rigorous requirements across several areas:
- Employment offer letters must now provide greater detail, including position duties, work modality, project scope, work location(s), and the business rationale for the assignment.
- Applicants’ professional backgrounds will receive closer scrutiny, encompassing academic credentials, technical experience, certifications, and professional degrees.
- Sponsoring employers will be subject to more rigorous review of their compliance standing and supporting documentation.
- Information on knowledge transfer, training, or capacity-building initiatives for Mexican personnel may be required.
- Adjudication and, where applicable, verification processes are expected to be more comprehensive.
Potential Impacts:
- Requests for additional documentation or clarification, before or after filing.
- Longer preparation timelines, particularly for technical, managerial, project-based, or multi-location roles.
- Greater coordination is needed across immigration, HR, payroll, tax, and business stakeholders ahead of filing.
- Possible inspection visits or compliance reviews in connection with employer registration and work authorization filings.
- Extended government processing times during the transition period.
