DOL Delays Prevailing Wage Determinations

The U.S. Department of Labor's National Prevailing Wage Center (NPWC) announced that it is currently is not issuing Prevailing Wage Determinations (PWDs).  The DOL announcement is available online at  The American Immigration Lawyers Association also reported that DOL has also suspended reviewing requests for reconsideration or appeals to the Center Director. These processes are on hold at this time as the NPWC is required by court order to reissue approximately 4,000 H-2B wage determinations by September 30, 2011.  

The DOL suspension of prevailing wage determinations began in early June 2011 and has not yet issued any estimate concerning when the agency would be able to resume issuing prevailing wage determinations for PERM labor certification applications. Tafapolsky & Smith is monitoring this problem closely and will provide updates as they become available.
