The American Immigration Lawyers Association reported today that according to USCIS, as of November 13, 2009 approximately 55,600 cap-subject H-1B petitions had been filed for FY2010. This means that roughly only 2,400 slots remain for the FY2010 allocation. Once these are exhausted, employers will have to wait until April 2010 to file applications for new, cap-subject H-1B visas that would become effective October 1, 2010. Employers are encouraged to contact their attorney to arrange to file any outstanding cap-subject petitions as soon as possible.
